College Arrest Blog 101 | Mugshot Website Legislation Proposed in Florida – Take 2

The Florida Legislature is taking up the pervasive problem with these Mugshot Websites again and it looks like this time it may pass. Read about it here. I have been complaining about these Mugshot websites that obtain arrestees' booking photos, also known as mugshots, from the jails as soon as someone is arrested and publishing them on their websites, along with their names and charges. Not only is the a great source of embarrassment for those arrested, but also many times charges are dismissed or expunged and these Mugshot websites never correct their data. Worse yet, they will not remove [...]

College Arrest 101 Blog | College Graduates and Background Searches for Employment

Graduation may finally be here for some college students.  Hopefully, post graduation plans include many employment opportunities.  It is rare these days to obtain a job without going through a criminal background check. These words will immediately invoke fear in many, many college students who may have partied too hard or made a silly, youthful mistake that resulted in an arrest during the college years. Almost all of my college student clients want to know what exactly is on their criminal background as result of an arrest and/or criminal case. When I handle a criminal case I am able to [...]

College Arrest 101 Blog | Spring Break Court in Key West

I love Key West. They really know how to deal with a problem down there. They have something called "Spring Break Court." Key West, like most big Spring Break destinations, suffers from many arrests of college students for relatively minor crimes like underage drinking, open container violations, fake IDs, etc. The problem with the arrest of a college student on Spring Break vacation is that they are not locals and must return to their home, usually hundreds of miles away, at the end of the week before their criminal case can come to court to be resolved. Key West has [...]

College Arrest 101 Blog | Good News for College Athletes with Criminal Records?

Last week the NFL finished up its 2013 annual draft in a time when there has been no shortage of college football players in the news for behavior off the field including arrests and suspensions.  This issue of college athlete arrests is not exclusive to football players, but every college sport experiences arrests of team members.  Policy varies widely from university to university regarding punishment for these student athletes - some receive almost no discipline while others are thrown off the team. However, this week it seems that things may be looking up for college athletes who face arrest and [...]

College Arrest 101 Blog | Florida Tries to Legislate Mugshot Websites

Finally! Someone in the Government wants to do something about these Mugshot websites which post the arrest mugshot of every college student arrested in Florida. Florida legislator, Carl Zimmermann, has proposed legislation that would undercut many of the problems with these mugshot websites - potentially putting them out of business. You can read discussion about the proposed legislation here and read the text of the bill here. I have long believed these websites are parasites, charging money to remove these embarrassing photos and information.  I have done legal research on the issue and even called the Florida Attorney General's office [...]

College students in Miami, Florida may be eligible to take advantage of a fairly new Driving Under the Influence (DUI) program called Back on Track (BOT). It is available only in the Miami-Dade County court system for first time DUI offenders and there are a number of criteria for eligibility and program requirements. College Arrest 101 Blog | University of Miami ULEAD Diversion Program

For all the University of Miami students and parents out there a fairly new program is available which you should be aware.  Its called ULEAD, which stands for University Law Enforcement Assisted Diversion Program.  This is a joint venture of sorts between the University of Miami and the Miami-Dade County State Attorney's Office which will allow students charged with certain crimes (right now just marijuana and paraphernalia possession and false ID cases) to completely avoid ever being arrested or formally charged in court with a crime.  The benefits of this program are enumerable because the student's name will never be [...]

College Arrest 101 Blog | Arrests and Enlisting in the Military

In observance of Veteran's Day today we will discuss issues that college students who may want to enlist in the Military may face after an arrest.  With Military enlistment for college students and recent college graduates on the rise, this topic is even more important to consider if you are a college student with an arrest in your background. Normally, after a college student is arrested the first issue on their mind is their "record" and how the arrest and disposition (outcome) of the criminal case will effect their "record."  The best outcome you could hope for after an arrest [...]

College Arrest Blog 101 | Mugshot Websites

Just when you college students thought that you cleaned up your online image by scrubbing your Facebook page of any inappropriate photos, etc., the Internet rears its ugly head again with Mugshot websites.  Any college student who has been arrested in the past year or so will soon learn that their face, i.e. their mugshot (the photo taken at their arrest) along with the accompanying arrest charges are all over the Internet on these new Mugshot websites. In Miami, Florida, where I practice criminal defense, this state is for some reason a hotbed for Mugshot websites.  If you were arrested [...]
